ELECTRONIC CIGARETTES
A federal judge ruled on January 14 that the FDA does not have authority to seize electronic cigarettes because the products don't qualify as devices subject to the agency's regulation, according to The Wall Street Journal's website.
The U.S. district judge found the FDA's interpretation of the law "unreasonable and unacceptable." The FDA has seized shipments of e-cigarettes due to concerns that the products are being marketed as "safer alternatives to traditional tobacco," the WSJ reported.
The two companies involved in the lawsuit that manufacture e-cigarettes, Smoking Everywhere and Njoy, claim that their products are less harmful than traditional cigarettes since they don't contain tar or produce smoke.
